FL Final Leg Roundup Part I: LGBTQ+ and Trans Youth & Guns

TALLAHASSEE, FL - Florida Legislature passes anti-LGBTQ youth "Parental Bill of Rights", attacks transgender and intersex youth through a last minute amendment passing the trans youth athlete ban, supports guns in religious schools, and passes preemption legislation which stops local municipalities from passing gun control measures and fines local municipalites who even have an unwritten conversation about it.



Bill: Anti-Transgender Youth Athletic Ban

Current Status: Passed the House and the Senate as a last-minute, behind-closed-doors amendment to the unrelated Charter School Bill on April 28, 2021. Is still ordered enrolled which means it is waiting for Governor DeSantis to sign it. DeSantis has stated out loud that this is a priority bill for him and that he will sign it. Like the anti-protest bill (HB1), voter suppression (SB90) and others he is probably waiting to make a media statement out of the signing.

Summary: Prohibits and limits participation in sports on the basis of sex assignment at birth and the ownership of one's original birth certificate. This means that transgender youth who have had their gender marker changed on their birth certificate will be prohibited from playing sports according to their actual gender rather than their sex assigned at birth. By default, the bill also prohibits intersex children from playing sports (since most do not have a "male" or "female" gender marker on their birth certificate) and also prohibits any child in the public or charter school system that does not have their original birth certificate including adopted children.

Actions: Send an email to the Governor of Florida and ask him to VETO the anti-transgender youth athlete legislation.

Bill: HB241/SB582 Unsafe Schools or so-called “Parental Rights”

Category: LGBTQIA+ Rights, Transgender Justice, Education, Healthcare, Public Health, Youth, Climate Justice, Racial Justice

Status: Passed the House and Senate and signed into law by the Governor.

Summary: Limits sex education, gives unreasonable rights to white supremacist and anti-LGBTQ+ parents control over curriculum, LGBTQ+ safety guidelines and practices (including using pronouns), and using inclusive language and policies for transgender and non-binary students through an "objectionable materials" process. Violates LGBTQ+ student privacy and rights by forcing school staff to out LGBTQ+ youth to parents, and will put things like black history, women's history, LGBTQ+ history, sex education and climate science education at risk if labled an "objectionable material" by conservative or white supremacist parent/group.

Bill: SB498/HB259 - Guns in Religious Institutions Bill

Status This Week:. Ordered enrolled and waiting to be signed into law by the Governor. Passed as HB259 in the House and Senate.

Summary: Allows for the conceal carry of weapons and firearms into schools that are part of religious institutions in Florida.

Bill: SB 1884 Preemption on Local Gun Regulation

Category: Guns, Preemption

Status: Passed in the House and Senate and was signed into law by Governor DeSantis on Friday, May 7th.

Summary: This legislation cracks down on local governments who create gun control measures and includes preemption language on local firearm and ammunition laws that also apply to unwritten rules and policies. The langauge also includes a $100,000 fine, attorney fees, and potential removal from office for local officials who try to pass local gun regulations. The law makes it clear that local municipalities in Florida cannot bypass court cases. Under this legislation local officials can also personally face $5,000 fines for attempting to pass gun regulations. The law goes into effect on July 1, 2021.
